From 1 July 2021, all same day delivery providers must capture and report their delivery data to Liquor & Gaming NSW every six months, to show the volume of packaged alcohol delivered as same day deliveries by postcode in NSW.

The ongoing reporting periods are:

  • 1 July to 31 December
  • 1 January to 30 June

Reports are due to us within 21 days of the end of each period.

Data reporting requirements

Same day alcohol delivery providers should provide a breakdown of the volume of packaged alcohol delivered to each NSW postcode by the type of alcohol:

  • Beer, cider, perry and mead
  • Wine (including all wine, rice wine and fortified wine)
  • Spirits - broken down by:
    • ready to drink (i.e. all pre-mix spirits, all cocktails)
    • all other spirits (i.e. standard spirits)

Volumes of each type must be reported as a combined total (in litres) supplied for each postcode, not as individual transactions.

Failure to submit data

Alcohol delivery data must be reported within 21 days of the end of each period under the Liquor Regulation 2018. Failure to do so may result in Liquor & Gaming NSW taking regulatory action.

Common questions

Do I need to report alcohol deliveries that were made ‘next day’ – i.e. not on the same day as the order was made?

No, your reporting data should only include alcohol deliveries that were made on the same day that an order was processed. Learn more about the types of same day alcohol deliveries on the alcohol delivery laws page.

Do I need to include same day delivered alcohol-free and ultra-light products (e.g. alcohol-free beer)?

No, your reporting data only needs to include packaged alcoholic beverages which, at 20° Celsius, contain more than 1.15% ethanol by volume.

I am a licensed business that sells alcohol that is only advertised for delivery by a different delivery partner or business (for example, an online food delivery business), do I need to submit a report?

No. In this case, it’s the delivery business that needs to report as they are:

  • indicating by advertisement they will supply the alcohol for same day delivery, and
  • delivering the alcohol using their own employees and/or other agents.

The delivery business must lodge a single report that covers all same day deliveries they make, including all alcohol they supply for your business and any others.

My licensed business uses its own website to take customer orders and advertise/offer same day delivery to customers. We sometimes take phone orders. I engage a courier and postal services to make the deliveries on the same day they are ordered. Do I need to submit a report?

Yes, you are the same day delivery provider and must lodge a report covering the alcohol delivered on the same day ordered, whether the order was taken over the website or by phone. You must also follow all the other laws that apply to these providers.

This applies equally to all types of licensed businesses – including packaged liquor licensees, hotels, clubs and others – that provide same day alcohol deliveries.

Do I need to report same day alcohol deliveries that were made interstate?

No, same day delivery reporting requirements apply for deliveries made to customers in NSW only.

Do I need to report same day delivery that were made to another licenced business?

No, deliveries to other licenced businesses, whether the alcohol is sold by wholesale or retail are exempt from reporting requirements.

Do I need to report same day deliveries where the alcohol was sold using temporary COVID-19 arrangements for restaurants, cafés, small bars and other venues that don’t usually have an ongoing authorisation for home delivery?

Yes, these are same day deliveries.

Can I lodge an amended report to correct a reporting error?

Yes, if you need to correct a mistake on your report please contact Liquor and Gaming NSW first before lodging any corrections.

Why are all same day delivery providers required to report delivery data?

Over time, your same day alcohol delivery data will assist Liquor & Gaming NSW and the Independent Liquor and Gaming Authority in:

  • understanding the number of same day delivery providers and delivery locations
  • understanding trends in the market for same day delivery
  • completing upcoming reviews of the same day alcohol delivery framework to inform future government policy
  • considering associated risks of alcohol-related harm in local and broader communities.

I run a courier company that makes same day alcohol deliveries for other licenced businesses. They take all the customer orders and advertise/offer the delivery from their own websites and mobile platforms. Do I need to submit a report?

No, the other licensed businesses are the same day delivery providers in this scenario. They are capturing the delivery data from end consumers and need to submit the report.

You should check that your staff and any others making the deliveries as part of the service you provide have been trained in Responsible Supply of Alcohol (RSAT) to help ensure they deliver the alcohol responsibly in line with NSW liquor laws.
