Alcohol delivery driver protections

What are the rules?

Under the NSW Liquor Laws, businesses offering same day alcohol delivery are not allowed to financially penalise delivery drivers if they refuse to make a same day delivery where it would result in them supplying alcohol to:

  • a minor,
  • an intoxicated person, or
  • where the delivery driver is unable to verify the identity of the person accepting the order.

Delivery drivers should never make a delivery under any of these circumstances, it is against the law.

You are protected by law and cannot be financially penalised by your employer for refusing to make a delivery for any of these reasons.

A financial penalty includes any action that has a financial impact on you including, for example, withholding or delaying your pay or loss of hours of employment.

What can I do if I’ve been penalised?

If you have been penalised by your employer for refusing to make a delivery under any of the above circumstances, you can report it to Liquor & Gaming NSW where the matter will be investigated.
