Non-completion of Licensee and Advanced Licensee Training

Liquor & Gaming NSW has provided a staged approach to assist licensees, managers or secretaries of licensed premises in their compliance responsibilities relating to both licensee and advanced licensee training.

What notice was provided?

Communications were sent to licensees, managers or secretaries of licensed premises on 15 January 2024 and 19 February 2024 advising that Licensee and/or Advanced Licensee training were to be completed by 1 April 2024.

What happens if training is not completed by 1 April 2024?

If training has not been completed, as required, licensees, managers or secretaries of licensed premises may be in breach of their obligations under the liquor legislation.

Are time extensions available to complete the training?

Legislation does not provide for an extension to complete licensee training.

What does this mean for licensees, managers or secretaries of licensed premises?

Under the Liquor Regulation 2018, the licensee, manager or secretary of licensed premises must not sell, supply or serve liquor by retail on the premises, or cause or permit liquor to be sold, supplied or served by retail on the premises, unless the licensee holds a recognised competency card with a current Licensee and Advanced Licensee endorsement.

Licensees, managers or secretaries of licensed premises who continue to sell, supply or serve liquor without having completed the required training may be in breach of the liquor legislation, and liable to penalties as a result.
